Chelsea and Australia football star Sam Kerr has issued an apology for “expressing myself poorly on what was a traumatic evening” after being found not guilty of racially aggravated harassment. The case stemmed from an incident where she called a Metropolitan Police officer “stupid and white” during an altercation in London.
Incident leading to charges
The 31-year-old striker was involved in an incident on 30 January 2023, when she and her partner, West Ham midfielder Kristie Mewis, were out drinking. A dispute arose with their taxi driver after he claimed they had refused to pay clean-up costs following an instance of sickness inside the vehicle. Matters escalated further when the driver accused them of smashing the rear window of his taxi. As a result, the pair were taken to Twickenham Police Station.
At the police station, Kerr allegedly became “abusive and insulting” towards Police Constable Stephen Lovell, referring to him as “f****** stupid and white.” The case ultimately went to trial, where Kerr denied any wrongdoing, maintaining that her words were not intended to cause harm or insult.
Court proceedings and not guilty verdict
A jury at Kingston Crown Court deliberated for just over four hours before returning a unanimous not guilty verdict on Tuesday. The case had garnered significant attention due to Kerr’s status as one of the leading figures in women’s football.
Following the verdict, Kerr released a statement expressing her relief that the ordeal was over and gratitude to those who had supported her. She said:
“Following today’s not guilty verdict, I can finally put this challenging period behind me. While I apologise for expressing myself poorly on what was a traumatic evening, I have always maintained that I did not intend to insult or harm anyone, and I am thankful that the jury unanimously agreed.
“I would like to thank my partner Kristie, my family, friends, and all the fans for their love and support, especially those who attended court each day.
“I am fully focused on getting back on to the pitch and look forward to an exciting year ahead for me and my family.”
Defence argument and allegations of unfair treatment
During the trial, Kerr testified that she believed she was being treated unfairly by the police. She told the jury that she felt discriminated against due to her ethnicity, particularly by PC Lovell.
She stated: “I believed they were treating me differently because of what they perceived to be the colour of my skin – particularly PC Lovell’s behaviour. The way he was accusing me of lying, and later arresting me for criminal damage even though Kristie said it was just her (who smashed the taxi’s window). At the time, I thought they were trying to put it on me.”
Controversy over the crown prosecution service’s (CPS) handling
The court heard that the Crown Prosecution Service had initially decided not to press charges against Kerr. However, a request for a review of the decision was submitted by the police, which ultimately led to the case being brought to trial almost a year after the incident.
Kerr’s legal team argued that the prosecution process was unfair and sought to have the case dismissed at a preliminary hearing. Defence lawyer Grace Forbes accused the CPS of violating its own guidance and suggested that a “loophole” in the victims’ right of review scheme was used to justify proceeding with the case.
A crucial element of the trial was whether PC Lovell’s initial statement mentioned the impact of Kerr’s comments. The jury was told that his first report did not specify any distress caused by her words. However, a later statement, submitted in December 2023, did mention that he had felt “shocked, upset, and humiliated” by the remark. This discrepancy was highlighted by the defence, who questioned why the additional evidence was only provided much later in the process.
During cross-examination, Forbes put it to PC Lovell that he had been “determined to pursue this person” through the courts, to which he responded affirmatively.
Moving forward
Kerr’s focus now shifts back to football, with Chelsea eyeing another successful season both domestically and in European competition. The verdict brings an end to a turbulent period for the striker, who has been a key figure in the Women’s Super League and a role model in the sport.
As she returns to training and competitive play, Kerr will be looking to move past the controversy and concentrate on delivering strong performances on the pitch. The incident and trial have brought significant media scrutiny, but her statement suggests she is eager to leave the episode behind and focus on the future.
